Commerce Ministry Stresses Legal Compliance in Trademark Registration

Hanoi:The Ministry of Commerce, Industry and Investment Promotion has highlighted the necessity for businesses and entrepreneurs to adhere to legal requirements when selecting, designing, and registering trademarks. This adherence is crucial to protect intellectual property rights, minimize commercial disputes, and boost consumer confidence and fair competition.

According to Oman News Agency, trademarks are vital intangible assets for businesses, playing a key role in distinguishing products and services, building commercial reputations, and enhancing market presence both locally and internationally. Eng. Khalid Hamoud Al Hinai, Director of the National Intellectual Property Office, emphasized the ministry's efforts to strengthen intellectual property rights protection and raise awareness about the importance of legally registering trademarks as a fundamental component for business growth and sustainability.

Al Hinai explained that creating a successful trademark involves more than selecting a unique name or designing a logo; it requires ensuring eligibility for registration and legal protection. The economic and investment value of a trademark increases with business expansion, and it is essential that this growth is grounded in legal principles that safeguard owners' rights and build consumer trust. The National Intellectual Property Office is committed to fostering a culture that respects intellectual property rights and informs stakeholders about trademark registration regulations.

He also underlined the importance of avoiding the inclusion of official flags, logos, and sovereign symbols in trademarks, as prohibited by law, to prevent misrepresentation of governmental connections. The use of country names, regions, and geographical indications is also regulated to avoid consumer confusion regarding the origin of goods or services.

Ghalib Mohammed Al Saidi, Head of the Commerce Section at the Directorate of Commerce, Industry and Investment Promotion in Musandam Governorate, noted that examining trademark applications is crucial to ensure legal compliance and protect trademark owners’ rights. He highlighted that applications are scrutinized for distinctiveness and eligibility, and legal impediments or existing rights conflicts are identified to prevent registration rejection.

He stressed the importance of using geographical names appropriately, ensuring they accurately reflect product origins, thus preserving producer rights and protecting consumers. Conducting a preliminary search before submitting a trademark application is recommended to identify potential legal issues early and reduce costs associated with modifying a commercial identity post-application.

The Ministry clarified that trademark registration in Oman is governed by the Trademarks Law (System) of the GCC and the Industrial Property Rights Law, which outline registration conditions, rejection reasons, and application examination procedures. Trademark applications are subject to legal scrutiny, with possible modifications or restrictions imposed to prevent confusion. Accepted trademarks are announced, with a 60-day objection period, and protection lasts 10 years, renewable under legal conditions.

The Ministry urged businesses and entrepreneurs to conduct thorough legal examinations of trademarks to ensure compliance with legal standards, emphasizing that awareness of these requirements is essential for developing robust and sustainable trademarks.
